If you have been injured at work or due to an accident that was not a fault of your own, you are probably getting more familiar with the rules that are associated with personal injury cases. But even though you may have reported your case to a local lawyer, you may be wondering why your case is taking so long. Here are a few things you should know about personal injury law that will help you to understand the case better, as well as some online sources that will help you to find an attorney if you don’t already have one.

In most cases, a long span of time goes by between the time that your lawyer files your personal injury lawsuit and you receive a settlement. And, you may be thinking that this is your attorney’s fault. In most states, the other parties insurance company does not owe you the courtesy of settling personal injury cases quickly, so your case can be settled before you even go to trial, or you could be waiting for your settlement for months or even years after your trial is over. The main reason for this is that the insurance companies know that you are eager to settle the case, and will take longer to give you the money that you deserve so that you will settle for a smaller amount.

In order to keep some personal injury cases dragging on longer than they should, insurance companies will go through a ‘discovery’ period with you. This means that the company will try to get every little detail about you and the accident, and you’ll get a lot of written questions from the insurance company that you’ll have to answer under oath. This is a tactic to prove that you don’t really deserve the amount of the settlement that you’re asking for, so you’ll need to work with your lawyer to make sure that you can gather all your medical bills, receipts for car or automobile repair, and documentation of injuries to give to the judge. Personal injury cases also require depositions in some cases, which means you’ll be asked a number of questions in court, and your answers will be typed by a court reporter. The insurance company will ask you lots of details about each of the aspects of the accident, and you may be continually questioned about the smallest details.

You may also be asked to undergo mediation in order to settle personal injury cases. This is when lawyers have to mediate the cases between you and the insurance company prior to the trial, and this is required in some states. This way, you may be able to settle out of court.
